Purchasing policies
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the “Rules”), after their approval by the Buyer (by checking the box indicating that you agree with the “balticmuscle.lt” rules when purchasing goods), are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions for the purchase and payment for goods, the procedure for the delivery and return of goods, the liability of the parties and other provisions related to the purchase and sale of goods in the “jeweledi.com” online store (hereinafter referred to as the Store). 1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by law.
2. Protection of personal data
2.1. Any information related to personal data and registered in the Store is considered confidential and not made public. 2.2. When ordering goods in the Store, the Buyer must provide the data requested during registration. 2.3. The Buyer is responsible for providing correct data during registration. 2.4. By placing an order, the Buyer agrees that the personal data provided by him will be processed for the purposes of order control and activity analysis. The Buyer also agrees that information messages necessary for fulfilling the order of goods will be sent to the e-mail address or phone number specified by the Buyer. 2.5. When registering in the e-store and ordering goods, the Buyer undertakes to keep the login data safe and not to disclose it to anyone. 2.6. The Seller undertakes not to disclose the Buyer's personal data to third parties, except in cases provided for by the legal acts of the Republic of Lithuania.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the Store in accordance with the procedure established by these Rules. 3.2. The Buyer has the right to withdraw from the contract of sale of goods concluded with the Store by notifying the Seller thereof by e-mail or telephone.
4. Buyer's obligations
4.1. The Buyer undertakes to pay the agreed price for the goods, indicating the exact purpose of payment and to accept them in accordance with the procedure established by these Rules. 4.2. The Buyer undertakes to choose the size of the goods that is right for him and is responsible for this himself. 4.3. The Buyer undertakes not to transfer his login details to third parties. And if he loses his login details, he must immediately inform the Seller about it. 4.4. By placing an order in the online store jeweledi.com, the Buyer agrees to these Rules of Sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
5. Seller's rights 5.1. If the Buyer attempts to undermine the stability and security of the Store or violates its obligations, the Seller has the right to immediately and without warning limit or suspend the Buyer's access to the Store or, in exceptional cases, cancel the Buyer's registration. 5.2. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer does not pay for the goods within 3 (three) business days.
6. Seller's obligations
6.1. The Seller undertakes to respect the Buyer's right to privacy to the personal information belonging to him, specified in the Store's registration form, and not to disclose the received data to third parties, except for the cases established by the legal acts of the Republic of Lithuania. 6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions specified in paragraph 8 of the Rules. 6.3. If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, he undertakes to offer an analogous or as similar product as possible. If the Buyer refuses to accept the analogous or most similar product, the Seller undertakes to refund the money paid to the Buyer within 3 (three) business days, if an advance payment was made.
7. Ordering goods, payment procedure and terms
7.1. In the online store, the Buyer can make purchases online 7 days a week, 24 hours a day. Orders by phone or e-mail are accepted during the established business hours, which are indicated in the contact section of the page. 7.2. The Buyer can pay for the goods using the e-banking system. The Buyer transfers money to the jeweledi.com current account. Responsibility for data security in this case lies with the relevant bank, in whose e-banking system monetary transactions take place. Or by paying by bank transfer, when the Buyer, having printed the order and gone to the nearest bank branch, transfers the money to the e-store's bank account. 7.3. The Buyer undertakes to pay for the order within 3 days from the date of order confirmation. The shipment is prepared only after receiving payment for the goods. 7.4. If the Buyer fails to make payment within 3 days or if only part of the money is transferred, or if the payment purpose is indicated incorrectly, the order is canceled. If the money was transferred to the jeweledi.com bank account, it is transferred back to the buyer within 14 days. 7.5. If the customer purchases a gift voucher and does not use it within the period specified in the voucher, the voucher is considered to have been used.
8. Delivery of goods
8.1. When ordering goods, the buyer undertakes to indicate the exact place of delivery of the goods and a contact telephone number. 8.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the buyer, the buyer has no right to make claims to the seller regarding the delivery of the goods to an inappropriate entity. 8.3. The goods are delivered by the seller or his authorized representative (postal, courier service). The Seller is not liable for the poor quality of the Lithuanian Post or couriers. 8.4. The Seller undertakes to deliver the goods to the Buyer in accordance with the stipulated delivery terms. These terms do not apply in cases where the Seller does not have the necessary goods in stock, and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of the goods. 8.5. In all cases, the Seller is exempted from liability for violation of the delivery terms of the goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Buyer's control. 8.6. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or its authorized representative. After the Buyer signs the invoice (waybill) or other document of delivery and acceptance of the shipment, the shipment is considered to be transferred in proper condition. 8.7. 9. Quality of Goods and Return Terms
9.1. The Seller is not responsible if the color, shape or other parameters of the goods in the store do not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer. 9.2. The goods are not returned if they are not suitable for the Buyer due to the Buyer's inaccurate choice. In such a case, the goods may be repaired at the Buyer's expense. 9.3. The return of goods is carried out in accordance with the Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 "On the Approval of the Rules for the Return and Exchange of Goods" and the Order No. 217 of 19 December 2013 "On the Approval of the Rules for the Return and Exchange of Goods" by the Law No. XII-700 on Amendments and Supplements to the Civil Code. 9.4. The Buyer must send the returned goods by registered mail of the Lithuanian Post. The buyer pays the postage costs of the returned or exchanged goods. 9.5. If the Buyer wishes to return the quality goods(s), the Buyer may do so within 14 days from the date of delivery of the goods to the Buyer, informing the Seller by e-mail. 9.6. The exchanged or returned goods must be presented in a neat original packaging, undamaged, unused, not having lost their commercial appearance (undamaged labels, untorn protective films, etc.) and in the same configuration in which the Buyer purchased them. 9.7. The Seller has the right not to accept the exchanged or returned goods if they do not comply with 9.6. the procedure for returning goods set out in point 1 or if it was made or adjusted according to an individual order (the color of the goods has been changed, the length of the goods has been adjusted, the engraving of individual text, etc.). 9.8. The money paid for the returned goods is refunded within 14 days from the date of receipt of the letter. 9.9. If the Buyer received the goods with a defect or which were damaged during shipping, the Seller will exchange the said goods (or if it is impossible to exchange - refund the money), and will compensate for the return costs.
10. Liability
10.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences arising from this. 10.2. The Buyer is responsible for the transfer of his login data to third parties. If the services provided by the Store are used by a third person who has logged into the Store using the Buyer's login data, the Seller considers this person to be the Buyer. 10.3. The Seller is exempted from any liability in cases where losses arise due to the fact that the Buyer, disregarding the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity. 10.4. If the Seller's Store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals. 10.5. In the event of damage, the guilty party shall compensate the other party for direct losses.
11. Final provisions
11.1. This agreement shall enter into force from the moment of payment for the goods. 11.2. These Rules for the purchase and sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania. 11.3. All disagreements arising from the implementation of these Rules shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
